By using the Services, you represent and warrant that:
All leads you upload or provide originated from your own lawful marketing efforts;
Each lead has provided legally valid consent to be contacted;
You have full authority to share, upload, and grant access to all data required to perform the Services.
RePitch AI and Andolina Holdings, LLC do not provide legal advice regarding SMS, TCPA, CTIA, carrier, or privacy compliance. You are solely responsible for ensuring that your lead data, consent language, and outreach practices comply with all applicable laws and regulations.

3. General Conditions
We reserve the right to refuse service for any reason, including but not limited to:
Abuse of systems, automations, or staff
Chargebacks, missed payments, or delinquent invoices
Submission of unverified, unconsented, or problematic lead data
Violations of carrier-level SMS policies or applicable regulations
You may not copy, resell, license, or exploit any portion of the Services, methodologies, strategies, frameworks, software, or proprietary processes without our prior written consent.
You acknowledge that certain data transmissions may occur over unencrypted networks during the delivery of Services.

4. No Guaranteed Results
Marketing, SMS outreach, and database reactivation performance varies based on factors beyond our control, including but not limited to:
Lead quality and age
Industry competition
Consumer behavior
Carrier filtering and limitations
Messaging volume and frequency
Economic and seasonal trends
Budget, timing, and implementation decisions
RePitch AI and Andolina Holdings, LLC make no guarantees regarding sales, conversions, appointments, revenue, deliverability, or performance. Any projections or forecasts are estimates only.

5. Changes to Services & Pricing
We reserve the right to modify pricing, retainers, packages, features, or service structures at any time without notice. We may also modify, suspend, or discontinue any Service or integration.
We are not liable for any business impact, loss, or disruption resulting from such changes.

6. Billing, Payments & Refunds

9. Client Data, Assets & Content Submissions
All data or content you provide must be:
Owned by you or properly licensed
Accurate, lawful, and non-infringing
By submitting content or data, you grant Andolina Holdings, LLC a limited right to store, use, modify, and process such materials solely as necessary to perform the Services.
You agree not to submit:
Purchased, scraped, or unlawfully obtained lead lists
Misleading or false business information
Harmful, malicious, or infringing files

Your sole remedy is limited to the amount paid for Services during the thirty (30) days preceding any claim.
